Terms of service

These Terms of Service ("Terms") are an agreement between you and Aquarium Plants Factory Inc. ("Aquarium Plants Factory", "APF", "we", "us" or "our"). They cover your use of aquariumplantsfactory.com and any related pages, emails, tools and programs (together, the "Site"), and every purchase you make from us. They combine our terms of use and our conditions of sale in one place.

By using the Site or placing an order, you agree to these Terms and to the policies they include by reference: our Privacy Policy, Shipping Policy, Returns, Refunds & Live Arrival Guarantee, and the terms of any promotion or program you take part in, such as the Buy 2 Get 1 Free terms and the APF Rewards terms. If a promotion or program's terms conflict with these Terms, the promotion or program terms apply to that promotion or program. If you do not agree, please do not use the Site.

1. Who can use the Site

You must be at least 18 years old, or the age of majority where you live, to place an order or create an account. You may use the Site only for lawful, personal purposes and in line with these Terms. Our store runs on Shopify, and payments are handled by our payment processors; their own terms also apply to the services they provide.

2. Your account

You are responsible for keeping your account login private and for all activity under your account. Please give us accurate, current information and keep it up to date. We may suspend or close accounts that break these Terms, misuse promotions, or show signs of fraud.

3. Products, live goods and plant care

• Living things vary. Our plants are living organisms. Size, color, leaf shape, growth form and quantity per portion can differ from the photos, which show typical examples. Plants grown above water in our greenhouse often change shape or shed leaves as they adapt to life underwater. This is normal and is not a defect.
• Photos, videos, illustrations and AI-assisted media. Product photos and videos show typical examples, not the exact plant you will receive. Some images and videos on the Site, including lifestyle scenes, aquascape concepts, animations, banners, backgrounds and some product images and videos, are created, generated or enhanced with digital editing or artificial intelligence (AI) tools. They are for illustration only. Your order is described by the listing title, the option you choose and the written description, not by any single image or video. If an image or video and the written description differ, the written description applies.
• Information only. Care guides, Plant Finder results, difficulty ratings and other information on the Site are general guidance. Results depend on your aquarium or pond, including water quality, light, CO2, nutrients, temperature and the animals you keep. We do not guarantee how a plant will grow in your setup.
• Your aquarium and animals. Please rinse and quarantine plants before adding them to your aquarium. Except for our Vitro Culture® tissue culture plants, which are grown in sterile conditions, we cannot guarantee plants are free of snails, algae or other hitchhikers. We are not responsible for losses of fish, shrimp, snails or other animals, or for damage to aquariums, ponds or equipment.
• Accessories and non-live items are covered by our Returns, Refunds & Live Arrival Guarantee.

4. Plant laws and environmental responsibility

Some aquatic plants are regulated or prohibited in certain states, counties or countries. You are responsible for knowing and following the laws where you live before you order. We may refuse, cancel or refund any order that we believe cannot lawfully be shipped to your address. Never release aquarium or pond plants, or water from your aquarium, into lakes, rivers, streams or other natural waterways. When you dispose of plants, seal them in a bag in the trash, or compost or dry them first.

5. Orders, pricing and payment

• Order acceptance. Your order is an offer to buy. Our order confirmation email is not an acceptance. We accept your order when we ship it. We may refuse or cancel any order, or limit quantities per person, household, address or account, for any reason. Reasons include stock limits, suspected fraud, pricing or listing errors, orders that look like they are for resale or commercial use, and orders we cannot lawfully ship. If we cancel after you are charged, we will refund the amount you paid.
• Pricing and errors. Prices are in US dollars and may change without notice. We work to keep prices, descriptions and stock accurate, but mistakes can happen. If a product is listed at the wrong price or with the wrong information, we may cancel the order and refund you, even after you receive an order confirmation.
• Taxes. We collect sales tax where required by law, based on your shipping address.
• Payment. You confirm that you are authorized to use the payment method you provide. Your card statement may show "Aquarium Plants Factory".
• Personal use. Products, prices and promotions on the Site are for personal, non-commercial use. Wholesale and resale buyers should contact us for separate terms.

6. Shipping, risk of loss and title

We currently ship within the United States only. Processing times, carriers, shipping days and weather holds are explained in our Shipping Policy. Delivery dates are estimates. Title and risk of loss pass to you when we hand your package to the carrier. Our Live Arrival Guarantee and lost-package rules still apply as described in our policies. Please give us a complete and accurate address, watch your tracking, and bring live goods indoors the day they arrive.

7. All sales final and the Live Arrival Guarantee

Because live plants and animals are perishable and could carry pests or disease back into our facility, all sales of live goods are final and we do not accept returns or exchanges of live goods. We stand behind arrival with our 24-Hour Live Arrival Guarantee. 8. Promotions, rewards and gift cards

• Promotions. Each promotion has its own terms, shown on the Site or with the offer. Unless stated otherwise, promotions have no cash value, apply only to orders placed while the promotion is active, cannot be applied to past orders, and may be changed or ended at any time. Free promotional items have no cash value. We may cancel discounts, rewards or orders obtained through error, fraud, multiple accounts or any misuse.
• APF Rewards. Our loyalty program is governed by the APF Rewards terms. Points and reward codes have no cash value and are not your property.
• Gift cards. Gift cards are redeemable for merchandise on aquariumplantsfactory.com. They do not expire and have no fees. Gift cards cannot be reloaded, resold or used to buy other gift cards, and cannot be redeemed for cash except where required by law (for example, California residents may redeem a remaining balance under $10 for cash). Please treat gift cards like cash. We are not responsible for lost or stolen gift cards or unauthorized use.

9. Payment disputes

If something is wrong with your order, please contact us first at hello@aquariumplantsfactory.com. We resolve nearly every issue quickly. Filing a chargeback or payment dispute without contacting us first may make the order ineligible for help under our policies. We may suspend accounts with repeated or unfounded disputes. Nothing in these Terms limits any rights you have under the law or with your card issuer.

10. Our brand and content

The Site and everything on it are owned by Aquarium Plants Factory or our licensors and are protected by copyright, trademark and other laws. This includes product photos, videos, plant descriptions, care guides, the Plant Finder, page designs, logos and software. Aquarium Plants Factory, APF, Vitro Culture®, APF Rewards and our logos are our trademarks. You may view and print pages for your own personal, non-commercial use only. Unless we give you written permission, you may not:

• copy, reuse or republish our photos, videos, descriptions or care content, including in marketplace listings, social media shops, websites or ads;
• use our names, trademarks or logos, or anything confusingly similar, in a way that suggests you are us, are affiliated with us or are endorsed by us, including in domain names, account names, keywords or ads;
• scrape, crawl, data-mine or bulk-download the Site, prices or reviews, or use automated tools to place orders or collect promotions; or
• frame or mirror the Site, or attempt to interfere with its security or operation.

We actively protect our brand and content. We may remove or report infringing listings, send takedown notices to marketplaces and hosts, and seek all remedies available under the law.

11. Reviews, photos and feedback you share

When you post a review, rating, question, photo or video on the Site, or send it through our review partner, you confirm that it is your own honest experience and that you have the right to share it. You keep ownership of your content. You give us a worldwide, royalty-free, non-exclusive, perpetual license to use, reproduce, display, edit for length or formatting, and share it in connection with our business, including on the Site, in emails and in ads, with or without your name or username. When you tag us or use our hashtags on social media, we may ask to share your post. We will credit you where practical. We may decline or remove content that is false, offensive, off-topic, promotional, or that breaks the law or these Terms. Reviews are never edited to change their meaning. Ideas and suggestions you send us may be used without any obligation to you.

12. Prohibited use

You agree not to use the Site to break any law; infringe anyone's rights; harass, threaten or defraud anyone; post false reviews or impersonate others; send spam or malware; probe, scan or test the Site's security; or collect information about other users. We may suspend or end your access to the Site at any time if we believe you have broken these Terms.

13. Third-party services and links

The Site may include links to, or tools from, third parties such as carriers, payment processors, review platforms and social networks. We do not control them and are not responsible for their content, policies or actions. Your use of them is at your own risk and subject to their terms.

14. Emails and text messages

You agree that we may send you order, shipping and account messages electronically, and that these meet any legal requirement for written notice. Marketing emails are sent only if you subscribe, and every marketing email includes an unsubscribe link. If you opt in to marketing text messages, message frequency varies, message and data rates may apply, consent is not a condition of purchase, and you can reply STOP to cancel or HELP for help.

15. Disclaimer of warranties

Except for the guarantees we expressly make in our policies, such as the Live Arrival Guarantee, the Site and all products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of viruses. Some states do not allow these exclusions, so some of them may not apply to you.

16. Limitation of liability

To the fullest extent permitted by law, Aquarium Plants Factory and its owners, employees, suppliers and partners will not be liable for any indirect, incidental, special, consequential or punitive damages. This includes loss of aquarium or pond animals or plants, damage to equipment, lost profits or lost data arising from the Site or any product, even if we were told such damages were possible. Our total liability for any claim relating to a product or order will not exceed the amount you paid us for that product. Our total liability for any other claim will not exceed $100. These limits do not apply where the law does not allow them, including for death or personal injury caused by our negligence, or for fraud.

17. Indemnity

You agree to defend, indemnify and hold harmless Aquarium Plants Factory and its owners, employees and partners from any claims, losses, damages, costs and expenses, including reasonable attorneys' fees, that arise from your misuse of the Site, your content, your breach of these Terms, or your violation of any law or anyone else's rights. This includes releasing plants into the environment or shipping them where they are prohibited.

18. Resolving disputes

• Talk to us first. Most concerns can be resolved quickly. Before starting any legal claim, you agree to email us at hello@aquariumplantsfactory.com with your name, order number (if any) and a description of the issue and the outcome you want. We will both try in good faith to resolve it within 60 days.
• Governing law. These Terms are governed by the laws of the State of California and applicable US federal law, without regard to conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
• Where claims are heard. If a dispute is not resolved informally, either of us may bring it in small claims court if it qualifies. Otherwise, you and we agree that claims will be brought only in the state or federal courts located in San Bernardino County, California, and both of us consent to those courts' jurisdiction, except where the law where you live gives you the right to bring a claim in your local courts.

19. Events outside our control

We are not responsible for delays or failures caused by events beyond our reasonable control. These include extreme weather, natural disasters, carrier or postal disruptions, pests or disease affecting our crops, supplier shortages, power or internet outages, labor actions, government orders and public-health emergencies.

20. Changes to these Terms

We may update these Terms from time to time. When we do, we will post the new version here and update the date at the top. Changes apply from the date they are posted. The Terms in effect when you place an order apply to that order. Your continued use of the Site after a change means you accept the updated Terms.

21. General

These Terms, together with the policies and program terms they reference, are the entire agreement between you and us about the Site and your purchases. If any part of these Terms is found unenforceable, that part will be limited to the minimum extent necessary and the rest will remain in effect. If we don't enforce a right immediately, we don't give it up. You may not transfer your rights under these Terms. We may transfer ours, for example as part of a sale or reorganization of our business. Headings are for convenience only. Sections that by their nature should survive, including sections 8 through 11 and 15 through 21, will survive any termination.
